Welcome to Attendi, developed and maintained by Bishnu Engineering. By purchasing our hardware, registering an account on our platform, or using our APIs, you legally bind your organization to the following Terms of Service.
1. Acceptance of Terms
These terms constitute a legally binding agreement between you (the "Client") and Bishnu Engineering. If you are accepting these terms on behalf of a corporation or other legal entity, you represent that you have the authority to bind such entity to these terms.
2. The Hybrid SaaS & Hardware Model
Attendi operates on a bifurcated business model:
- Hardware Purchase: The physical IoT devices (any version of Attendi v1) are purchased as a one-time capital expenditure. You own the physical hardware upon full payment.
- SaaS Subscription: Access to the Attendi Cloud Dashboard, data processing APIs, and report generation tools is provided on a recurring subscription basis. Failure to renew the SaaS subscription will result in the hardware losing its ability to sync data to the cloud.
3. Hardware Warranty & Constraints
Bishnu Engineering provides a limited one (1) year warranty on all supplied physical devices against manufacturing defects. This warranty is strictly voided under the following conditions:
- Tampering with the Attdendi device circuitry or attempting to re-flash the proprietary firmware.
- Physical damage, water damage (unless expressly sold as an IP67 waterproof unit), or power surges resulting from faulty local electrical wiring.
4. System Uptime & SLA
We target a 99.9% uptime for our cloud servers. However, Bishnu Engineering is not responsible for data synchronization failures resulting from:
- Local Wi-Fi or router failures at your facility.
- Poor GSM/Cellular signal if using SIM-based scanner modules (e.g., BSNL network drops).
- Power outages at the deployment site causing the device to power off.
Note: Devices contain a minor offline buffer. However, prolonged network outages may result in lost punches. Ensuring stable local connectivity is the Client's responsibility.
5. Client Obligations
You agree not to use the platform to violate any local employment laws. You are solely responsible for managing the Admin credentials assigned to your company portal. Bishnu Engineering will not be held liable for unauthorized internal data exports resulting from compromised weak passwords within your organization.
6. Limitation of Liability
To the maximum extent permitted by Indian law, Bishnu Engineering shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of payroll data, or operational disruptions arising out of the use or inability to use the Attendi service. Our total liability shall not exceed the amount you paid us for the software subscription in the three (3) months preceding the claim.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms, the SaaS platform, or the physical hardware shall be subject to the exclusive jurisdiction of the competent courts located in Jorhat, Assam, India.
